CUSTOMER INFORMATION NOTICE REGARDING THE PROTECTION OF YOUR PERSONAL DATA IN ACCORDANCE WITH THE LAW ON THE PROTECTION OF PERSONAL DATA NO. 6698 ("KVKK") PROCEDURES AND PRINCIPLES

We, Mikla Food and Beverage Joint Stock Company ("Company"), have prepared this Information Notice to explain to you which personal data we will process for what purposes.

  • Your personal data that we obtain in the ways specified below,
  • Within the scope of our legal relationships,
  • In a manner limited, related to the purposes requiring processing, and proportional,
  • By maintaining the accuracy and most up-to-date status of the personal data as you have notified us or as they have been notified,
  • Will be recorded, stored, preserved, rearranged, shared with institutions authorized to request such personal data under the Law and, in accordance with the conditions prescribed by the KVKK, transferred to third parties within the country, transferred, classified, and processed in other ways specified in the KVKK.

What is the Legal Basis for Processing Your Personal Data?

By law, your personal data can only be processed if at least one of the conditions set forth in the Law is met. As a Company, regardless of the purpose for which we process your personal data, we process them in compliance with national and international legislation, primarily the fundamental principles in Article 4 of the Law, and based on the personal data processing conditions listed in Articles 5 and 6 of the Law. In this context, we process our customers' personal data within the scope of our legitimate interests, provided that it does not adversely affect the fundamental rights and freedoms of our customers, as well as for purposes explicitly envisaged by the laws, establishment or performance of a contract, fulfillment of our legal obligations, and not causing an adverse consequence on our customers' fundamental rights and freedoms.

Which Personal Data Do We Process?

The personal data that may be subject to processing by us or that you share with us, or that are necessary, are as follows:

  • Identity Data: Name, Surname, Turkish Citizenship Number (TCKN)
  • Contact Data: Address, telephone, e-mail address
  • Financial Data: Information regarding payments made and payment methods, first and last four digits of credit card numbers
  • Visual Data: Camera recordings
  • Audio Data: Audio recordings of conversations with the call center
  • Legal Transaction Information: Information in correspondence with authorized individuals, institutions, and organizations, information in lawsuit and execution files, legal information request information

How and for What Reasons Do We Collect Your Personal Data?

To fulfill our legal obligations, perform sales contracts, reasons envisaged in the laws, and based on our legitimate interest, we collect your personal data through verbal, physical, or electronic means when you share them with us. We also collect visual data through camera recordings placed in our headquarters and branches to ensure workplace security. We also collect personal data through legal documents and notifications to fulfill our legal obligations.

WHAT PURPOSES DO WE PROCESS YOUR PERSONAL DATA FOR?

We may process the personal data you provide us with, as well as other personal data you may share with us, for the following purposes:

To conduct the service provider-customer relationship we establish with you, especially:

  • Refunding amounts to credit card accounts in case of erroneous transactions

To fulfill certain processes that we are obligated to perform within the framework of the relevant legislation, especially:

  • Creating invoices and preparing expense vouchers
  • Issuing e-archive invoices

To improve the service we provide to you, enhance ourselves, and carry out marketing and research activities, especially:

  • Informing about the Company's activities, innovations, and conducting marketing activities
  • Conducting customer satisfaction analysis
  • Contacting you based on the completion of customer satisfaction forms and informing you about important developments via email or SMS if requested

For the administration of the Company, the conduct of business, and the implementation of Company policies, especially:

  • Ensuring workplace security
  • Observing positive or negative situations at the headquarters and branches

To exercise our right to defend against legal claims, especially:

  • Managing consumer complaints

We process your personal data for a maximum period as required by the relevant legislation or for the maximum statutory limitation periods.

SHARING YOUR PERSONAL DATA WITH THIRD PARTIES DOMESTICALLY

Your personal data may be transferred to specialized firms in the field or servers of the applications we use for the performance of certain activities.

For example,

  • In case of erroneous transactions, your name, surname, and the first and last 4 digits of your credit card may be transferred to the banks to refund the amounts to credit card accounts.
  • In case you fill out customer satisfaction forms, your data necessary for the performance of the activity may be transferred to contracted service providers who send bulk SMS and electronic messages for the purpose of contacting you and informing you about important developments via email or SMS.
  • In case of a police/prosecutor's decision for the fulfillment of the Company's legal obligations, camera recordings at headquarters and branches may be transferred to the relevant authorities.

Additionally, within the framework of our obligation to fulfill legal requests such as court decisions, Consumer Arbitration Board decisions, or requests for evidence detection, we may share your personal data with relevant institutions.

YOUR RIGHTS

In accordance with Article 11 of the KVKK, you have the following rights regarding your personal data, provided that you prove your identity to us personally:

You can learn whether your personal data is processed by us, If your personal data is processed by us, you can request information about it, You can learn the purposes for which your personal data are processed and whether they are used for these purposes, You can learn the third parties to whom your personal data are transferred, domestically or abroad, If your personal data are processed incompletely or inaccurately, you can request their correction and request that the corrected data be transmitted to the third parties to whom your personal data have been transferred, Even if your personal data are processed in accordance with the Law and other relevant national and international legislation, if the reasons requiring the processing of your personal data have disappeared, you can request the deletion or destruction of your personal data and request that the corrected data be transmitted to the third parties to whom your personal data have been transferred, If a result adverse to you arises as a result of the analysis of the data processed by automatic systems exclusively, you can object to this result, If you suffer any damages due to the unlawful processing of your personal data, you can request the compensation of the damage caused by the unlawful data processing.

You also have the right to request the correction of your incorrect and incomplete personal data and to inform the recipients to whom your data has been or may be transferred.

You can request the destruction of your personal data (deletion, destruction, or anonymization) in accordance with the conditions specified in Article 7 of the KVKK. You can also request that the recipients to whom the data have been or may be transferred be informed about your request for deletion and/or correction of the data. However, depending on the conditions of the specific case, the appropriate method for deletion or correction will be determined by us. In this context, you can always request information from us about why we chose the deletion method we selected.

If the results of the analysis of your personal data created solely by an automatic system are contrary to your interests, you can object to these results.

If you suffer any damages due to the unlawful processing of your personal data, you can request compensation for the damage.

Your requests in your application will be concluded free of charge within thirty days at the latest, depending on the nature of the request. However, if the process requires an additional cost for the Company, a fee may be charged according to the tariff determined by the Data Controllers' Board.

In order to submit your application regarding the processing of personal data, you must submit your application to our Company by filling out the application form on the Company's website, in writing, or using the registered electronic mail (KEP) address, secure electronic signature, mobile signature, or the electronic mail address you have previously notified us and which is recorded in our records. Depending on the nature of your application and the method of application, additional verifications (such as sending a message to your registered phone, calling you, etc.) may be requested by us to determine whether the application belongs to you and thus to protect your rights. For example, if you apply through the email address registered with the Company, we may contact you using another communication method registered with the Company to confirm whether the application belongs to you.
